For the sake of mutual respect and to ensure the proper operation of our services and your stays, we ask you to read these general terms and conditions of sale carefully and to accept them.
The person validating these terms and conditions acknowledges that they are of legal age and have full legal capacity.
These general terms and conditions apply to all bookings with Villas Capucines made on our Website or on any other sales platform. Booking a villa implies acceptance of these general terms and conditions of sale, which prevail over any prior terms or any general terms and conditions of purchase.
Article 1 – General Conditions of Use of the Website
The User of this Website is liable for any damage of any kind, whether material or immaterial, direct or indirect, caused to any third party and/or to Villas Capucines as a result of the unlawful use and/or exploitation of the Villas Capucines website itself and/or any of its elements, regardless of the cause or the place where such damage occurs, and shall indemnify Villas Capucines against the consequences of any claims or actions that may be brought against it as a result.
The User of the Villas Capucines website waives any right to take action against Villas Capucines in the event of legal proceedings brought by a third party against them as a result of the unlawful use and/or exploitation of the Villas Capucines website.
Article 2 – General Booking Conditions
By making a booking, you agree to receive:
- A confirmation email summarizing the terms of the booking contract, the services booked, the prices, and the conditions related to the selected rate.
- An email before your arrival so that we can organize your arrival as efficiently as possible and arrange a meeting on site for the property tour and handover of the keys.
- Check-in and check-out:
Check-in (time from which the villa is available): from 4:00 p.m. to 8:00 p.m. free of charge.
From 8:00 p.m. to 10:00 p.m. (upon request), with an additional charge of EUR 50 to be paid to the person on site.
From 10:00 p.m. to midnight (upon request), with an additional charge of EUR 80 to be paid to the person on site.
No check-in can take place after midnight.
It is preferable to let us know your arrival time as soon as possible for better organization.
Check-out (latest time by which the client must leave the villa): 10:00 a.m.
No late check-out will be accepted.
We may ask you for a copy of your national identity card and/or passport, in particular for payment security purposes (for example, in the absence of the 3D Secure or SCA – Strong Customer Authentication – system).
2/ Your email address must be complete and valid, as we send your booking confirmation to this email address.
3/ Your mobile phone number must be complete and valid, and it must be the number you will use upon arrival.
10/ Tourist tax is regulated by the municipality of Sète. Since January 2021, it has been set at EUR 3.30 per night per person. The tourist tax is added to the total amount of your booking. Only adults are concerned.
11/ Any behavior by the Client and/or their guests that is contrary to safety and/or hygiene principles, rules of peace and quiet, public decency, and/or public order may lead Villas Capucines to require the Client to leave the booked villa, without refund.
Article 3 – Payment Conditions
Your bank card details are required by Villas Capucines on the Website in order to guarantee your booking and payment. No banking information is stored on our Website, but rather on a specialized and secure platform: ATOS (a trusted third-party payment processor).
In order to protect and encrypt your bank card data when it passes through our Website, standard SSL (“Secure Socket Layer”) security technology is used when providing our services. Banking transactions are processed via the ATOS platform.
Payment for your stay is made at the time of booking.
Cancellation conditions:
For bookings (arrival date) between September 1 and June 30:
Cancellation is free of charge up to 14 days before the arrival date.
After this period, cancellation fees amount to the total cost of the stay.
For bookings between July 1 and August 31:
Cancellation is free of charge up to 21 days before the arrival date.
After this period, cancellation fees amount to the total cost of the stay.
Article 4 – Security Deposit
A security deposit will be required upon arrival, in the form of a bank cheque or bank deposit.
The villa cannot be rented without it. The deposit is set at EUR 2,000 per villa.
The deposit will be returned within a maximum period of one week after the guests’ departure.
If any deterioration or damage is caused during your stay, we reserve the right to present you with the invoices for repairs attributable to your damage.
Either we will collect the bank deposit, or we will cash the security cheque and return the balance to you. If the damage is too significant, the full deposit may be cashed and retained.
Article 5 – Pets
Pets are not allowed. In the event of non-compliance with this rule, a cleaning fee of one hundred euros (EUR 100) will be charged. Please consult us in advance for further information.
Article 6 – Non-Smoking
Villas Capucines is strictly non-smoking. Failure to comply with this condition will result in the intervention of a company specialized in cleaning and disinfection. The cost of this intervention will be billed directly to the Client in the amount of one hundred euros (EUR 100), corresponding to the cost of smoke-removal cleaning.
Article 7 – Prohibition of Domiciliation
The Resident is prohibited from using or distributing, as a primary residence or business address, the address of their suite and/or the address of Villas Capucines.
By accepting these general terms and conditions of sale, the Resident acknowledges that they are in no way acting for commercial purposes.
Article 8 – Insurance and Personal Belongings
Villas Capucines accepts no responsibility for the safekeeping of any personal belongings left by the Resident in the Villa, whether they are present or not.
Your personal belongings and valuables are not covered by our insurance. We strongly recommend that you insure, for yourself and the persons travelling with you, all luggage, belongings, and valuables of each person against loss or theft. Personal liability insurance is also recommended for each person.
During your stay, please make sure to properly lock the front door and the gate in order to avoid any issues.
Article 9 – Peace and Quiet
The Resident shall ensure that peace and quiet are not disturbed at any time by their behavior or that of their guests. The use of sound equipment (music, television, DVD) is permitted as long as the resulting noise does not disturb the neighbors and applicable laws and regulations are respected (in particular Article R. 623-2 of the French Criminal Code). Villas Capucines is located in a quiet residential neighborhood. We invite all our Residents to respect this calm environment.
It is forbidden to organize any kind of party, whether inside the villa, in the outdoor areas such as the gardens, or by the swimming pool.
If this is the case, we expressly reserve the right to terminate your stay through the intervention of the night security team (between EUR 350 and EUR 650 depending on the time of intervention; this amount will be specified to you at the time of the intervention).
Article 10 – Inspection of the Premises
Staff members of Villas Capucines may access the rented suite to check the proper functioning of the facilities and carry out repairs, refurbishments, or alterations, at any time.
Article 11 – Compliance with Laws and Regulations
Each Resident is responsible for disturbances and violations of the laws and regulations in force. The Resident’s use of the internet is subject to current French legislation (Books I and II of the Intellectual Property Code) and shall remain the Resident’s responsibility if they fail to comply with such legislation. Villas Capucines is equipped with secure Wi-Fi with traceability. Access to certain websites is monitored.
Article 12 – Guarantee & Cancellation of the Booking
In the event of damage and/or theft, Villas Capucines reserves the right to charge the amount thereof to your bank card, or to cash the security cheque and refund the difference.
The maximum capacity of Villas Capucines villas is 6 people. We will not accept more than this number.
If it appears that the number of people occupying the villa exceeds the number stated at the time of booking, a penalty of EUR 50 incl. VAT per additional person beyond the number stated in the booking, per night, may be charged.

Article 13 – Shortened Stay
In the event of any interruption of the stay before the scheduled departure date, the full amount of the initially planned stay will be charged as compensation.
The invoice issued at the end of your stay may, where applicable, be used for reimbursement purposes (bank card insurance or other insurance in the event of illness or another serious incident covered by your insurance).
Article 14 – Liability
Villas Capucines declines all responsibility in the event of death or bodily injury or material damage to any person renting or using a Capucine villa unless this results from proven fault on the part of our staff or ourselves. Villas Capucines declines all responsibility in the event of loss, damage, or delay due to a cause beyond its will or control, including cases of force majeure, explosions, floods, storms, fire, accidents, acts of war or civil or terrorist threats, restrictive measures by any official authority, strikes, demonstrations, etc. In such cases, the rental agreement may be terminated automatically and no compensation may be claimed by the Resident. Villas Capucines cannot be held responsible in the event of breakdown of public utility services such as water, electricity, internet, or television.
Villas Capucines declines all responsibility for noise and nuisances of any kind that are beyond its will or control or that do not originate within the rented villa.
The Resident undertakes not to use the villa for pedophilic, pornographic, terrorist, or any other illegal purposes.
Villas Capucines cannot be held responsible in the event that the villas are used for such purposes.
After departure:
Any property belonging to Villas Capucines and not returned will be subject to immediate billing at the replacement cost of the item, the amount of which may be deducted from the bank guarantee.
Article 15 – Hardship / Unforeseeability
These general terms and conditions of sale expressly exclude the legal regime of unforeseeability provided for in Article 1195 of the French Civil Code for all Services provided by Villas Capucines to the Client. The Client therefore waives the right to rely on the provisions of Article 1195 of the French Civil Code and the hardship regime provided therein, undertaking to assume their own obligations even if the contractual balance is upset by circumstances that were unforeseeable at the time of booking and concluding the rental contract, even if performance becomes excessively onerous, and to bear all economic and financial consequences thereof.
Article 16 – Services
Extra bed:
No extra bed may be added in the villas.
Existing bedding arrangements may not be modified.
Children:
A children’s kit is available free of charge: baby cot, high chair.
Available upon request.
Only one kit per villa may be provided.
Cleaning:
A fixed fee of EUR 150 per stay is due when purchasing a stay.
This rate cannot vary.
Linen:
Bed linen as well as bathroom towels for the indoor bathrooms are provided.
Pool towels are not provided and must be brought by the tenants.
Parking:
The villa can accommodate two standard-sized cars. The street also offers free parking along its entire length.
